These Terms of Service (“Terms”) govern access to and use of tuumiist.com and related products and services operated under the TUUMIIST brand (collectively, the “Services”). By accessing the Services or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.

1. Eligibility and Acceptable Use

You must be at least the age of majority in your state of residence, or use the Services with the involvement and consent of a parent or legal guardian. You may not use the Services for unlawful, fraudulent, abusive, infringing, harmful, or unauthorized purposes, interfere with security or operation, introduce malicious code, or attempt to collect information from the Services through unauthorized means.

2. Accounts

You are responsible for providing accurate information and maintaining the confidentiality of account credentials. Notify us promptly of suspected unauthorized use. We may suspend or terminate an account when reasonably necessary to protect customers, TUUMIIST, or the Services, or to address a violation of these Terms.

3. Product Information

We try to present product descriptions, specifications, images, colors, availability, and prices accurately. Screen settings and manufacturing updates may cause minor differences. We may correct errors, update information, limit quantities, or discontinue products, subject to applicable law.

Product statements on the Services are for general informational purposes and are not medical advice. TUUMIIST products are not intended to diagnose, treat, cure, or prevent disease. Follow product instructions and applicable safety warnings.

4. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may decline or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, payment failure, shipping restrictions, or unauthorized resale. If we cancel after payment, we will refund the amount paid for the cancelled portion.

You agree to provide current and accurate billing, payment, contact, and delivery information. Products are sold for personal or household use unless we approve otherwise in writing.

5. Prices, Payments, and Promotions

Prices are shown in U.S. dollars unless stated otherwise. Applicable shipping charges and taxes are displayed at checkout. Payment is processed by third-party payment providers and is subject to their terms.

Discount codes and promotions may have expiration dates, product exclusions, minimum purchase requirements, usage limits, and other stated conditions. Unless expressly allowed, promotions cannot be combined, applied retroactively, redeemed for cash, or transferred. We may end or correct a promotion as permitted by law, but will honor completed orders where legally required.

6. Shipping

Shipping is governed by our Shipping Policy: https://tuumiist.com/policies/shipping-policy. Delivery dates are estimates unless expressly stated to be guaranteed. If we cannot ship within an expressly promised time, we will provide the choices required by applicable law, which may include agreeing to a delay or cancelling the unshipped order for a refund.

7. Returns and Refunds

Returns, refunds, exchanges, and cancellations are governed by our Refund Policy: https://tuumiist.com/policies/refund-policy. Nothing in these Terms limits non-waivable rights under applicable law.

8. Limited Warranty

Unless a product page or written warranty states otherwise, eligible TUUMIIST products include a 12-month limited warranty beginning on the original delivery date. Eligible customers who complete the published extension process may receive 3 additional months, for a total of 15 months.

The limited warranty covers qualifying defects in materials or workmanship under normal household use. It does not cover ordinary wear, cosmetic damage that does not affect operation, misuse, abuse, accidents, improper cleaning or maintenance, unauthorized repair or modification, commercial use, use outside instructions, or damage caused by external power, shipping after customer receipt, or non-TUUMIIST accessories. Proof of purchase, product information, and photos or video may be required. Remedies may include troubleshooting, replacement parts, repair, replacement, or another remedy required by law.

9. Reviews, Feedback, and Submissions

If you submit a review, photo, video, suggestion, or other content, you represent that you have the right to provide it and that it is accurate and lawful. You grant TUUMIIST a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, translate, and display the content for operating and promoting the Services, subject to applicable privacy law. We may moderate or remove content that violates law, these Terms, or platform rules.

10. Intellectual Property

The Services, including trademarks, branding, text, graphics, images, video, software, and design, are owned by or licensed to TUUMIIST and protected by applicable law. Except as expressly permitted, you may not copy, modify, distribute, sell, license, or exploit them without written permission.

11. Third-Party Services and Links

The Services may rely on or link to third-party platforms, payment providers, carriers, apps, and websites. Third parties operate under their own terms and privacy notices. To the maximum extent permitted by law, TUUMIIST is not responsible for third-party services outside our control.

13. Disclaimer of Warranties

EXCEPT FOR EXPRESS WRITTEN WARRANTIES AND RIGHTS THAT CANNOT BE EXCLUDED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUUMIIST DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUUMIIST AND ITS AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM THE SERVICES OR PRODUCTS. WHERE LIABILITY CANNOT BE EXCLUDED, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TUUMIIST and its affiliates, personnel, and service providers from third-party claims arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights. This obligation does not apply to the extent a claim was caused by TUUMIIST.

16. Governing Law and Disputes

These Terms are governed by applicable United States law and the law of the state in which the TUUMIIST operating entity is organized, without regard to conflict-of-law principles. This section must be updated with the specific state before publication if TUUMIIST wishes to designate a governing state or forum. Nothing here deprives a consumer of protections that cannot be waived under applicable law.

Before filing a formal claim, you and TUUMIIST agree to try in good faith to resolve the issue by contacting support@tuumiist.com. This informal-resolution provision does not prevent either party from seeking relief where delay would cause harm or where prohibited by law.

17. Changes to the Services or Terms

We may update the Services and these Terms for operational, legal, security, or regulatory reasons. The revised Terms will be posted with an updated date. Changes apply prospectively unless applicable law requires otherwise. Continued use after an effective update constitutes acceptance where permitted by law.

18. Severability and Waiver

If a provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. These Terms and incorporated policies constitute the agreement regarding the Services, except for any separate written agreement signed by TUUMIIST.
